Terms of Service

These Terms of Service ("Terms") govern your access to and use of products, software, websites, hosted services, subscriptions, and other services provided by Spartan Software Solutions ("Spartan," "we," "us," or "our").

1. Agreement to Terms

By accessing, using, downloading, purchasing, or subscribing to any Spartan Software Solutions product or service, you agree to these Terms and any policies referenced within them, including our Refund Policy and Privacy Policy.

If you do not agree to these Terms, you may not use our products or services.

2. Accounts & Account Formation

Certain services require an account created through an email address and credentials, Discord authentication, or another supported authentication provider.

You are responsible for:

• Providing accurate account information.
• Maintaining the security of your credentials.
• Activities performed through your account.
• Keeping access to connected third-party accounts, such as Discord, secure.

You may not sell, transfer, share, or provide unauthorized access to your Spartan account or license unless expressly permitted by us.

3. Age Requirements

Spartan Software Solutions products and services are intended for users 18 years of age or older.

Individuals under 18 should not independently purchase or enter into a paid agreement for our services. Where permitted by applicable law, use by a minor should occur only with the involvement and authorization of a parent or legal guardian.

We strongly discourage anyone under 16 from using our services without direct parental or guardian consent and supervision.

4. Purchases & Licensing

Purchasing a Spartan product grants you a limited license to use the product according to the license type purchased. A purchase does not transfer ownership of Spartan Software Solutions, its source code, intellectual property, trademarks, designs, or underlying technology.

Unless expressly stated otherwise, licenses may not be resold, redistributed, sublicensed, leaked, shared, reverse engineered, or otherwise made available to unauthorized users.

Licenses may contain technical restrictions regarding the number of servers, communities, users, installations, or instances permitted.

5. Lifetime & One-Time Licenses

A product advertised as a Lifetime License, Lifetime Access, or One-Time Purchase means that recurring subscription payments are not required for the purchased license.

"Lifetime" does not guarantee that a product, platform, integration, hosting provider, third-party dependency, game platform, or online service will operate indefinitely.

We may modify, replace, discontinue, or retire products when continued operation becomes impractical, technically impossible, commercially unreasonable, or dependent upon discontinued third-party technology.

6. Subscription Services

Subscription services provide access for the duration of the purchased billing period.

Subscriptions may automatically renew until canceled unless otherwise stated during checkout. You may cancel an eligible subscription at any time. Cancellation prevents future renewals but does not normally terminate access for the billing period already purchased.

There are no cancellation penalties unless expressly disclosed before purchase.

7. Hosted Services

Some Spartan products depend on infrastructure operated by us or third-party providers.

We aim to provide reliable services but do not guarantee 100% uptime or uninterrupted availability.

Temporary outages may occur because of:

• Maintenance or updates.
• Software or hardware failures.
• Network or hosting-provider outages.
• Cyberattacks or security incidents.
• Third-party platform outages.
• Emergency maintenance.
• Events outside our reasonable control.

We may temporarily suspend services when reasonably necessary for maintenance, security, upgrades, or protection of our infrastructure.

We may also permanently discontinue a hosted service or product when continued operation is no longer reasonably feasible. Where practical, we will attempt to provide reasonable notice of significant permanent discontinuations.

8. Acceptable Use

You may not use Spartan products or services to:

• Violate applicable law.
• Circumvent licensing or authentication systems.
• Reverse engineer protected or proprietary components except where applicable law expressly permits it.
• Redistribute, leak, resell, sublicense, or pirate our software.
• Attack, overload, exploit, or interfere with our infrastructure.
• Gain unauthorized access to another account or service.
• Intentionally abuse bugs, vulnerabilities, or exploits.
• Use our services to distribute malware or malicious code.
• Fraudulently obtain services, licenses, refunds, credits, or account access.

Security vulnerabilities should be reported to us rather than intentionally exploited.

9. Support

We may provide support through our website, ticketing system, community platform, documentation, or other designated support channels.

Support availability, response times, and scope may vary by product or service. Unless expressly included in a service agreement, we do not guarantee a specific response or resolution time.

Customers are expected to review available documentation and provide reasonable diagnostic information when requesting technical assistance.

10. Refunds

Purchases are subject to our separate Refund Policy.

Eligibility depends on the type of product or service purchased, the date of purchase, the circumstances of the request, and other conditions described within that policy.

11. Third-Party Services

Our products may integrate with or depend upon third-party services such as Discord, FiveM/CFX, Stripe, hosting providers, APIs, game servers, operating systems, or other software.

We do not control these third parties and cannot guarantee their continued availability, compatibility, policies, pricing, or functionality.

Changes made by a third party may temporarily or permanently affect Spartan products without being caused by Spartan Software Solutions.

12. Disclaimer of Warranties

Except where prohibited by law, our products and services are provided "as is" and "as available."

We make no guarantee that every product will be error-free, uninterrupted, compatible with every configuration, or suitable for every customer's specific intended use.

Customers are responsible for reviewing product requirements, documentation, demonstrations, compatibility information, and available trial opportunities before purchasing.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Spartan Software Solutions will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use our products or services, including loss of data, revenue, profits, community activity, or business opportunities.

To the extent liability cannot legally be excluded, our aggregate liability relating to a product or service will generally not exceed the amount you paid Spartan Software Solutions for the product or service giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

14. Suspension & Termination

We reserve the right to restrict, suspend, or terminate access to our products, hosting, support systems, community platforms, or accounts when we reasonably determine that a customer has:

• Materially violated these Terms.
• Circumvented licensing restrictions.
• Redistributed or pirated our software.
• Abused our infrastructure or staff.
• Engaged in fraud or fraudulent payment activity.
• Intentionally exploited our systems.
• Created a security risk to Spartan or its customers.

Depending on the severity of the violation, termination may occur without prior notice.

Termination resulting from a violation of these Terms does not automatically entitle the customer to a refund.

15. Intellectual Property

Spartan Software Solutions retains all rights, title, and interest in its software, source code, branding, graphics, documentation, systems, designs, and other intellectual property unless expressly stated otherwise.

Purchasing a license grants permission to use the applicable product; it does not transfer ownership of our intellectual property.

16. Changes to Products & Terms

We may update our products, services, features, pricing, policies, or these Terms as our business and technology evolve.

Material changes to these Terms will take effect after publication or any additional notice required by applicable law.

Continued use of our services after updated Terms become effective constitutes acceptance where permitted by law.

17. Governing Law

These Terms are governed by the laws applicable to Spartan Software Solutions' principal place of business, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

18. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
